Good to know
Newmarket is in York Region, so buyers pay Ontario land transfer tax but no municipal land transfer tax. The legal questions here come from character homes near Main Street, lots in the Lake Simcoe watershed, and the Town's rule that every second unit be registered. Here is what we watch for.

What Makes a Newmarket Closing Different

One land transfer tax

Newmarket has no municipal land transfer tax. On a $950,000 home, Ontario land transfer tax is $15,475, and an eligible first-time buyer can receive up to $4,000 back. In the City of Toronto, the same home would also carry a municipal tax of $15,475. Our land transfer tax guide shows how each bracket is calculated.

The Lower Main Street South Heritage Conservation District

Newmarket has a Heritage Conservation District on Lower Main Street South under Part V of the Ontario Heritage Act, and the Town requires a heritage permit to alter or demolish a property in the district or a designated property (see the Town of Newmarket heritage pages). If you are buying a character home near Main Street, we check whether it is designated or inside the district before you plan any changes.

Lots in the Lake Simcoe watershed

Newmarket is in the area of the Lake Simcoe Region Conservation Authority, which regulates development near watercourses, valley lands and wetlands. The Authority says a permit is needed only if the property is in a regulated area, and the Town may still require its own approvals (see the Conservation Authority permit page). We raise these limits before you commit to an addition or a pool.

Second units must be registered

The Town says all additional residential units in Newmarket must be registered, after the building permit and final inspection (see the Town of Newmarket page). If a home you are buying has a second unit, we ask for the permit, inspection and registration records so you know whether the unit is legal.

Freehold and condominium townhomes

A townhome can be freehold or part of a condominium corporation, and the difference changes what we review. For a condominium townhome we read the status certificate, the reserve fund and the monthly fees. For a freehold townhome we check title, easements and any shared driveway or maintenance arrangements.

New homes from a builder

For a new condo, you generally have 10 days after receiving the disclosure statement and signed agreement to cancel, and we use that window to review the agreement. For a new home, we check that the Tarion warranty paperwork is in order. See our Tarion warranty guide and our pre-construction condo service.
