Real Estate Lawyer in Brampton

Real Estate Lawyer Serving Brampton Buyers, Sellers, and Investors

Sarkaria Sethi LLP acts on home and condo purchases, sales, refinances, private lending, and pre-construction closings across Brampton, from Castlemore and Bramalea to Mount Pleasant and Heart Lake. We work from our office on Highway 7 in Vaughan, and you speak directly with your lawyer from the first call through closing.

Good to know
Brampton is in Peel Region, so buyers pay Ontario land transfer tax but no municipal land transfer tax. Brampton regulates rental units and secondary suites closely, and its zoning rules are changing, so a few extra checks belong in a purchase. Here is what we watch for.

What Makes a Brampton Closing Different

One land transfer tax

Brampton has no municipal land transfer tax. On a $850,000 home, Ontario land transfer tax is $13,475, and an eligible first-time buyer can receive up to $4,000 back. In the City of Toronto, the same home would also carry a municipal tax of $13,475. Our land transfer tax guide shows how each bracket is calculated.

Rental licensing and basement apartments

Brampton licenses rental properties, and from January 1, 2026 licences are renewed every year across the city, with an online course for new and renewing landlords. Fines for renting without a licence can reach $1,500 for repeat offences (see the City of Brampton announcement). If a home has a basement apartment, we check the unit’s status during the title and municipal searches so you do not inherit a problem.

A new zoning by-law

Brampton passed Comprehensive Zoning By-law 14-2026 in February 2026. It is under appeal to the Ontario Land Tribunal, and the older By-law 270-2004 still applies alongside it, with the stricter rule governing (see the City of Brampton zoning page). If you plan an addition, a wider driveway, or a rebuild, we check the survey and zoning against both.

Estates in Castlemore and Credit Ridge

Large lots and custom builds, sometimes bordering a ravine or protected land, can fall under Credit Valley Conservation rules. We review title, the survey, and any conservation limits, and discuss title insurance coverage that suits a higher-value home.

Older homes in Bramalea and mature Brampton

Older properties can have building permits that were never closed, such as a basement permit from decades ago. We run the municipal searches so you do not take on an open permit.

New builds in Mount Pleasant and near Gateway Terminal

For pre-construction, we review the builder’s agreement during your 10-day cooling-off period, including levies and assignment rights, and explain interim occupancy fees. For new homes, we check that the Tarion warranty paperwork is in order. See our pre-construction condo service.
